Terms of Sales

These UMUS general conditions (hereinafter referred to as the “General Conditions”) govern the relationships between:

The User (as defined in article 1 below) on the one hand

And

The company UMUS, simplified joint stock company, with share capital of €17,800, registered with the RCS of Arras under number 910 079 185, whose head office is located at 17 Boulevard Strasbourg 62000 Arrass, represented by its manager, Madame Clothilde GAUMY

On the other hand

Hereinafter collectively referred to as the “Parties” and individually a “Party”.

IT WAS PREVIOUSLY EXPOSED THAT:

UMUS' activity is the development and operation of the website accessible at the URL address: www.umus.fr

The Site is a platform offering the online sale of shoes, clothing items and fashion accessories (as defined in article 1 below).

ARTICLE 1 – DEFINITIONS

The Parties agree and accept that the following terms used with a capital letter, in the singular and/or plural, have in the context of these General Conditions, the meaning given to them below:

“BUYER” means any User who purchases one or more Item(s) on the Site.

“ANNOUNCEMENT” means any offer to sell one or more Item(s) on the Site.

“ITEM” means any footwear product, clothing items and fashion accessories offered for sale on the Site.

“ORDER” designates the process of online purchase of an Item by any Buyer on the Site.

“DELIVERY TIME” means the period between the date of validation of the Order by the Buyer on the Site and the date of delivery of the Order to the Buyer.

“DELIVERY” means the transfer of physical possession of the Items from UMUS to the Buyer having validated the Order process and validly made payment.

“USER” means any Internet user browsing the Site.

ARTICLE 2 – PURPOSE OF THE GENERAL CONDITIONS

The purpose of these General Conditions is to define:

the conditions under which UMUS allows Users to access the Site;

the terms of distance sale of Items between UMUS and the User on the Site.

 

ARTICLE 3 – INFORMATION ON THE SITE AND ACCESSIBILITY OF THE SITE

The Site is reserved for retail sales to individuals acting for personal purposes.

The Site is accessible to all Users of the internet network in principle 24 hours a day, 7 days a week, except interruption, scheduled or not, by UMUS or its service providers, for the needs of its maintenance and/or security or in the event of force majeure. (as defined below in Article 16.4.). UMUS cannot be held responsible for any damage, whatever its nature, resulting from unavailability of the Site.

UMUS reserves the right to change the Site, for technical or commercial reasons.

UMUS reserves the right to adapt or modify these general conditions of sale and use at any time.

ARTICLE 4 – APPLICATION AND ACCEPTANCE OF THE GENERAL CONDITIONS

The User must read the General Conditions before placing any Order.

The fact for a User to validate the Order process constitutes irrevocable and unreserved acceptance of all the stipulations of the General Conditions.

The General Conditions form a contract between UMUS and the User.

If the User refuses to comply with any of the obligations and conditions contained in the General Conditions, he must renounce access to and use the Site.

The User declares and guarantees having the legal capacity to contract.

The General Conditions constitute the entire agreement between the Parties and supersede any previous agreement or understanding, oral or written relating thereto.

The General Conditions applicable to an Order are those in force at the time of placing said Order and accepted by the User in accordance with this article.

ARTICLE 5 – TERMS OF REGISTRATION ON THE SITE

Users have the possibility, in order to subscribe to the UMUS newsletter, to register on the Site.

Registration on the Site is free and accessible to any User.

The User can register on the Site by filling in their email address in the box reserved for this purpose.

ARTICLE 6 – ITEMS FOR SALE ON THE SITE

The Items offered for sale are those described on the Site on the day the User consults the Site, within the limits of available stocks.

UMUS cannot be held responsible for the cancellation of an Order for an Item due to exhaustion of stocks.

The products are accompanied by a description that is as precise as possible but not exhaustive and non-contractual photos.

The photographs of the products are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to the colors, the representation of which may vary from one computer to another.

ARTICLE 7 – PRICES OF ITEMS

The prices of the Items are indicated on the Site in euros, VAT included, but excluding customs fees and other possible taxes. Customs fees and other taxes must be paid by the Buyer directly to the carrier.

UMUS reserves the right to modify its prices at any time but the Items will be invoiced on the basis of the prices in force at the time of registration and payment of the Order, subject to availability.

The Items are payable in cash upon placing the Order.

ARTICLE 8 – ORDER PROCESS

The Buyer wishing to purchase a product on the UMUS site must have the legal capacity or hold parental authorization allowing them to place an order.

The conclusion of the sale will only be effective after sending an email confirming the registration of the order (with an order number) by UMUS, provided that the email address indicated by the Buyer in the form registration does not contain errors.

ARTICLE 9 – REFUSAL TO PROCESS AN ORDER

UMUS reserves the right not to validate the order in the event of:

abnormal orders;

abnormal or abusive exchanges and returns;

existing dispute(s) with the User;

objective suspicion of fraud;

Questionable, fraudulent or invalid delivery address.

UMUS reserves the right to remove any Article displayed on the Site at any time and to replace or modify any content or information appearing on the Site.

UMUS cannot be held responsible towards the Buyer or a third party for the harmful consequences of the withdrawal of an Item on the site, or the replacement or modification of any content or information appearing on the Site, or even the refusal to process a order after sending the confirmation email summarizing the Order.

DELIVERY

Delivery address

Delivery occurs by receipt of the Items at the postal address indicated during the Order.

UMUS delivers the Items in France and abroad to any valid address.

Shipping cost

The amount of Delivery costs depends on the amount of the Order and the country of delivery. The Buyer is informed of this during the Order process, prior to its final validation.

Delivery delay

UMUS makes its best efforts to deliver Orders within a maximum period of:

  • twelve (12) working days for Delivery in Metropolitan France;
  • twenty (20) working days for Overseas or International Delivery.

Delivery times are in working days and run from the first working day following validation of the Order.

In order for these deadlines to be respected, the Buyer must ensure that they have communicated accurate and complete information concerning the Delivery address (such as, in particular: street number, building number, stair number, building codes). access, names and/or intercom numbers, etc.).

Transportation

UMUS will make its best efforts to ensure that the Order is prepared and delivered to the carrier within an average time of one (1) to five (5) working days from the day following that of the Buyer's validation of their Order.
Deliveries are made during working days.

Deliveries are ensured by the services of La Poste COLLISSIMO or any other carrier chosen by UMUS when shipping the Order.

Responsibility during transport

UMUS cannot be held responsible for possible entry errors and the consequences in terms of delay or delivery error, nor in the event of loss, damage or other damage to packages during delivery.

In this context, all costs incurred for reshipment will be the responsibility of the Buyer.

In the event of a delivery delay of more than five (5) days, we advise the customer to contact their post office to ensure that their package is not pending; and if necessary, to report this delay by email to contact@umus.fr

In order to validate any order, the Buyer must necessarily accept these general conditions of sale and use.

Checking the package

Upon receipt of the package, the Buyer must check the condition of the products before accepting delivery. In the event of damage noted on the delivery, the Buyer must mention his reservations on the delivery note and reiterate them to the carrier by registered letter with acknowledgment of receipt within three (3) days of delivery in accordance with the provisions of the article L.133-3 of the Commercial Code.
He must also send a letter to UMUS by email and registered letter with acknowledgment of receipt of any damage due to transport within eight (8) days following receipt.
No complaints will be accepted in the event of non-compliance with these formalities.

Failure to file a complaint within the aforementioned period extinguishes any action against the carrier in accordance with article L.133-3 of the Commercial Code.

UMUS cannot be held responsible for any harmful consequences resulting from a delivery delay, only reimbursement of the Items and Delivery costs being possible, to the exclusion of any other form of compensation.

 

Impossibility of delivery

If it is impossible to carry out the Delivery, due to an incorrect delivery address or the absence of collection by the Buyer of his Order from the collection point, the return and/or reshipment costs will be at his own expense. charge.

UMUS will, in any event, be released from its obligation to deliver in the event of:

– non-performance by the Buyer of any of its obligations (payment of price, accuracy of personal information)

– occurrence of a case of force majeure.

BILL

The Buyer may obtain a copy of the invoice(s) corresponding to their Order(s) by sending their request by email to contact@umus.fr



RIGHT OF WITHDRAWAL, EXCHANGES AND RETURNS

All products are subject to an exchange or refund except those marked otherwise.

In accordance with Article L221-18 of the Consumer Code, when a product has been purchased by an individual from a professional seller on the internet, the Buyer has a period of fourteen (14) working days from the date of receipt of the products to exercise your right of withdrawal.

The right of withdrawal is exercised without penalty, with the exception of return costs.

The Buyer returns the Order no later than fourteen (14) days following communication of their decision to withdraw, in accordance with article L.221-21 of the Consumer Code.

After the 14-day withdrawal period, no refund will be made.

The item(s) must be returned to UMUS only by Colissimo or carrier, in their original packaging, in their original condition, new, unworn, unwashed, and must not have suffered even minor damage.

Damaged or incomplete products will not be taken back.

In order to facilitate the processing of the request, UMUS asks the Buyer to send it an email to the following address: contact@umus.fr indicating the number of their order, then to reship the item accompanied by the invoice to the postal address given to him.

Upon receipt of the package, UMUS will judge the perfect condition of the returned Item(s).
No returns will be accepted if the returned Items have been visibly used or damaged by the Buyer, this use or damage making the Items unfit for sale.

If the return is refused by UMUS for the reasons set out above, the Items will then be returned to the Buyer at the latter's expense without the latter being able to demand any compensation or right to reimbursement.

The return of the Items is the responsibility and risk of the Buyer. It will therefore be up to the Buyer to keep all proof of return.

Reimbursement of the Order by UMUS is made no later than fourteen (14) days from the date on which it is informed of the Buyer's decision to withdraw, subject to having received within this period the Articles subject to the right of withdrawal.

UMUS makes the reimbursement using the same means of payment as that which was used to pay for the Order.

REFUND POLICY
The Buyer will be reimbursed for the amount of their purchase excluding delivery costs: the return costs remaining at their expense.

UMUS makes the reimbursement using the same means of payment as that which was used to pay for the Order.

After the 14-day withdrawal period, no refund will be made.
